High Court Upholds Divorce Decree Citing Wife’s Cruelty: PH High Court Grants Divorce to Man and Awards Alimony
Recently, the Punjab and Haryana High Court affirmed a divorce decree in favor of a man, citing cruelty and desertion by his wife, who had also filed false cases against him. The husband had initially filed a petition under Section 13 of the Hindu Marriage Act, 1955, seeking dissolution of the marriage due to cruelty and desertion. Although the family court had dismissed his plea earlier, the High Court revisited the case.
The bench of Justice Ritu Bahri and Justice Nidhi Gupt reviewed the husband’s claims that after their marriage in November 2012, they lived together for only nine months. Allegations included the wife’s disrespectful behavior, frequent quarrels without cause, and her departure in September 2013 with all dowry items, refusing to return or reconcile.
Countering these, the wife accused her husband of cruelty, illegal dowry demands, physical abuse, and neglecting her financial upkeep. The court found discrepancies in her claims and noted unsubstantiated allegations against the husband’s family.
In its verdict, the High Court observed irreconcilable differences and prolonged separation since 2013, despite failed mediation attempts. It overturned the family court’s decision, granting the husband’s appeal for divorce to bring closure to the legal dispute.
Additionally, the court awarded the wife permanent alimony amounting to Rs. 18 lakhs as a final settlement, acknowledging Rs. 23 lakhs previously paid by the husband during litigation.
This ruling marks a significant legal resolution in a complex matrimonial dispute, providing clarity and closure to both parties involved.
